Terms and Conditions of Use
Effective Date: 30 June 2025
The website Like New Only (the "Site") is managed and hosted by Like New Only Canada Ltd. (the "Company"), located in Surrey, BC Canada.
By signing up on the Site, you agree to comply with these Terms and Conditions and the Privacy Policy. Registration is free.
1. Purpose
1.1 These Terms define the relationship between Like New Only and its Users or Visitors. By using the Site, you agree to these Terms.

1.3 The Site enables Users to buy and sell Items and access additional services.
1.4 The Site is not for:
- Minors (under the legal age of majority), unless supervised by a parent/guardian.
- Professional/commercial sellers.
1.5 When registering, Users must provide basic details like name, email, and password. Additional information may be requested. Verification of your account may be required.
1.6 Like New Only may update these Terms. Users will be notified of any changes and can accept or reject them within 30 days. Continued use implies acceptance of new terms.
2. Definitions

Additional Services: Paid services offered by Like New Only.

Shopper: A User who purchases Items on the Site.

Catalogue: The Site’s electronic catalogue where Items are listed for sale.

integrated Payment & Shipping: Services to facilitate payment and delivery of Items.

Items: Goods listed for sale, allowed under applicable law.

Main Services: Core features like listing Items, purchasing Items, and interacting with other Users.

News: Content related to offers, competitions, and new services.

Public Comments: User-posted comments visible to all Site users.

Privacy Policy : Describes how personal data is handled.

Seller: A User who lists Items for sale.

Transaction: A sale between a Shopper and a Seller.
3. Services
3.1 Like New Only is an online platform for buying and selling Items. It offers a catalogue, integrated payment and shipping, and communication features.
3.2 Like New Only is not involved in any Transactions and is not responsible for the quality or safety of Items listed.
3.3 These Terms apply to both registered Users and Visitors, including those using Like New Only's social media accounts.
4. Listing Items
4.1 Seller Responsibilities
To list an Item, Sellers must:
- Follow the rules under FAQ – For Seller - Listing.
- Ensure the Item is not prohibited and complies with applicable laws.
- Own the Item and have the right to sell and transfer ownership.
- List safe, non-counterfeit Items that meet market standards.
- A listing is a binding offer to sell the Item, which may be accepted when a Buyer completes the checkout process.
4.2 Item Listing Requirements
Sellers must:
- Provide accurate information for the Item listing and transaction.
- Describe the Item accurately, noting any defects.
- Upload 6–9 clear photos of the actual Item (no internet-sourced or similar photos).
4.3. Seller Representation
By listing, the Seller confirms the Item matches the description and photos provided.
4.4 Fees
Listing Items is free. Multiple Items may be listed, but no Item can be listed more than once.
4.5 Item Changes
Sellers can withdraw or change the price of an Item before the sale is finalized
4.6 Item Compliance
Items must match the description and photos. If the Shopper receives an Item that differs significantly (e.g., counterfeit, severe damage, incorrect description), it is considered Significantly Not as Described. Minor differences or size issues do not count as such.
5. Sale of Items
5.1 Purchasing Shoppers can purchase Items using the Integrated Payment System by completing the checkout process after adding Items to their cart.
5.2 Binding Contract By finalizing a purchase, a legally binding contract is formed between the Shopper and Seller. The Shopper can add multiple Items to their cart and purchase in one transaction.
Like New Only is not a party to the transaction and is not responsible for the quality or safety of the Items. Shoppers use Items at their own risk.
5.3 Checkout Process
When a Shopper clicks “Buy Now” and completes the checkout process, the Seller’s offer is accepted
6. Shipping Costs and Responsibilities
6.1 Responsibility for Shipping Costs
As the shopper, you are responsible for all shipping costs associated with your order. Shipping fees are calculated based on the shipping method selected and the destination address provided.
6.2 Buyer Protection Coverage
Items shipped through Shippo's platform are eligible for liability coverage. The coverage details are as follows:

Canada Post Shipments: For Canada Post services used via Shippo, liability coverage of up to $100 is included for loss or damage.

UPS/FedEx/DHL: These carriers typically offer limited liability coverage by default (often up to $100) and allow you to purchase additional insurance for higher-value items.

Additional Insurance: For enhanced protection, you have the option to purchase additional insurance through Shippo's partnership with XCover.
6.3 Claims for Damaged or Lost Items
In the event that an item is damaged or lost during shipping, please follow these steps:

Damaged Items:

Press the I HAVE AN ISSUE BUTTON and fill out the form with a detailed description to report the damage.

Provide evidence of the damage, such as photographs, to assist in the claims process.

Lost Items:

If an item is confirmed lost, please press the I HAVE AN ISSUE button and fill out the form with a detailed description.

We will verify the status and, if necessary, file a claim with Shippo and Canada Post or another shipping company.

Once confirmed lost, you will be reimbursed for the item's value, including the shipping cost, up to the coverage limit provided by the shipping company.

Please note that claims for lost items must be initiated within specific timeframes:

Domestic Shipments (within Canada): Claims must be started within 48 hours of the delivery date by pressing the I HAVE AN ISSUE button.
6.4 Significantly Not As Described
If the Item differs significantly from the description (e.g. severe damage, wrong item), the Shopper must press the I HAVE AN ISSUE button and fill in the description of the issue within 48 hours of the Item being delivered as indicated by the seller or shipping company.
6.4.1 Refunds for Significantly Misdescribed Items
Shoppers and Sellers should try to resolve the issue themselves within 48 hours. If they can’t, Like New Only will step in, ask for evidence, and may request the Shopper return the Item to the Seller at the Shopper’s cost. If the Item is confirmed Significantly Not As Described (eg severe damage or wrong item), Like New Only will refund the Shopper after the returned Item is received by the Seller.
6.4.2 Completion of Transaction
Within 48 hours of the Item being delivered, as indicated by the seller or shipping company, if the Shopper does not indicate an issue with their order by pressing the I HAVE AN ISSUE button or confirms that the Item is acceptable by pressing the ALL IS WELL button, the transaction is considered complete, and the Shopper is not entitled to a refund.
6.5 Non-Insurable Items

6.6 Additional Notes:

- Address Accuracy: Ensure that the shipping address provided is accurate to avoid delays or additional charges.
7. INTEGRATED PAYMENT SERVICE
7.1 The Shopper must pay for the purchased Item(s) in advance using a credit or debit card, or other available payment methods through the Site’s Integrated Payment Service.
7.2 Payments, including the Item price, Platform fee, and Shipping Fees (the “Total Purchase Price”), are held by Stripe until the transaction is complete. The payment will be released to the Seller when:
- The Shopper confirms the Item has been received and is as described by clicking the ALL IS WELL button.
- Automatically after 48 hours if neither the ALL IS WELL button or the I HAVE AN ISSUE is not pressed.
- After a dispute is resolved.
7.3 Users acknowledge that a third-party processor handles payments and stores their credit/debit card information. The Shopper is responsible for transmitting this information, and Like New Only is not liable.
7.4 The Integrated Payment Service is for transactions made in the User’s name only. Users cannot resell, hire, or allow others to use the payment service. Like New Only may suspend services if this condition is violated.
7.5 If fraud is suspected, Like New Only will suspend the User’s account and any ongoing transactions until the investigation is complete.
7.6 If the payment provider reports suspicious activities (e.g., illegal sales, fraud), Like New Only can suspend the User’s account and transactions.
7.7 Like New Only may suspend a User’s account if they initiate a dispute with an external payment provider or breach these Terms and Conditions.
8. SHIPPING
8.1 Like New Only allows access to third-party shipping services. The same rules apply if another provider is used. Once shipping is selected and paid for, the payment is held in escrow, confirmed with the Seller, and shipping instructions are sent.
This is the shipping option:
- Integrated Shipping Labels: Like New Only generates a shipping label for the Seller. If the Item is lost or damaged, the Shopper may be reimbursed, and the Seller may get compensation based on the shipping provider's policy.
8.2 Shipping Fees are shown on the Item’s Price breakdown page and are paid by the Shopper, in addition to the purchase price and platform fee.
8.3 The Seller must ship the Item(s) within seven (7) days. If not, the transaction automatically expires and is considered cancelled. The seller will not receive any payment for the expired sale.
8.4 The Shopper and Seller may agree on personal delivery. In this case, shipping fees do not apply.
9. PAYMENT AND REFUNDS
9.1 All prices are in Canadian Dollars (CAD), and applicable taxes are added based on the Shopper’s location. Like New Only collects and remits sales tax as required by law.
9.2 Buyers can pay with a credit card, debit card, virtual card, or other approved payment methods.
9.3 The full Transaction amount is paid by the Shopper and will be transferred to the Seller when the Transaction is complete. If the Item is lost, damaged, or significantly not as described, the Shopper’s payment will be refunded.
9.4 After a return or cancellation, Like New Only will refund the Buyer based on the following:
- For a single Item: Full purchase price and platform fee for returned item.
- For multiple Items: Full purchase price, and platform fees for all returned Items.
- For partial returns: Refund for the returned Items, and platform fees.
The Shopper is responsible for shipping fees for returned items (6.4.1)
10. CANCELLATION REQUESTS
10.1 Shoppers and Sellers can request cancellations after completing the purchase transaction:
- Before the Seller presses the ITEM SHIPPED button
The transaction is automatically expired and cancelled if the Seller does not accept or ship the order within 7 days after purchase transaction is complete.
The request suspends the transaction, and Like New Only holds the total payment until the request is resolved.
10.2 The receiving party has 48 hours to approve or reject the request. If accepted:
- If the Item is not yet shipped, the Seller must keep the Item and funds will be returned to the Shopper.
- If the Item is marked as ‘delivered by the shipping company or seller’, the Shopper must return the Item at their own expense if it meets the criteria for significantly not as described (eg severe damage or wrong item).
10.2.2 If rejected or not responded to within the timeframe, Like New Only will escalate the issue and make a final decision
10.3 If the cancellation is approved, the Buyer will be refunded as per section 9.4.
11. INTERACTION AND MESSAGES ON THE SITE
11.1 Users can exchange information through Public Comments, but only for Items listed on the Site. The following are prohibited:
- Advertising, spam, or viruses.
- Inappropriate, insulting, or defamatory comments.
- Harassment or unlawful messages
11.2 Automated tools detect inappropriate comments, and such content may be hidden or blocked. Users may face account suspension if violations continue.
11.3 Feedback between Users is allowed only after a completed transaction. The feedback must be honest and fair. Like New Only may remove inappropriate feedback or block Users who violate these rules.
12. RESPONSIBILITY
12.1 Users and visitors are fully responsible for the content they post on the Site, including listings, descriptions, and transactions. Sellers are responsible for the quality, safety, and accuracy of the items they offer. Users engage in transactions at their own risk.
12.2 Users and visitors must comply with all applicable laws and avoid the following:
- Violating third-party rights, including intellectual property rights.
- Promoting illegal activities, discrimination, or hate.
- Sharing false or confidential information.
- Defaming others or violating privacy rights.
- Engaging in actions that endanger minors or misrepresenting their identity.
12.3 Users and visitors are responsible for any damages or losses resulting from non-compliance with these terms. Like New Only is not responsible for verifying content or for any damages related to user actions or content.
12.4 Like New Only is not responsible for user-uploaded content, but will remove content that violates the law or its policies. Users should report unlawful content immediately
12.5 The Internet is not a secure network, and Like New Only cannot guarantee the security or performance of the Site. Users are responsible for protecting their data from potential risks like cyberattacks or viruses.
12.6 Like New Only is not liable for cyberattacks, security breaches, or performance issues related to data transmission.
13. USER OBLIGATIONS
13.1 Users must:
- Provide accurate registration information (name, email).
- Only create one account unless informed otherwise by Like New Only.
- Avoid using the Site for illegal or fraudulent activities.
- Ensure the accuracy of any information related to sales or items listed.
13.2 Users and visitors must refrain from:
- Sharing misleading or illegal information.
- Selling prohibited or counterfeit goods.
- Using or sharing content they don't own the rights to, or that violates good moral standards.
- Spreading viruses or promoting other sites offering similar services
13.3 Users must not collect or share other users' data without proper authorization.
13.4 Like New Only is not responsible for users' behavior or transaction failures.
13.5 Users must keep their login details confidential, except for authorized parties
13.6 Users must promptly update their information when it changes.
13.7 Users represent that:
- They are of legal age or have parental consent.
- They are using the Site for personal, non-professional purposes.
- They have the capacity to complete transactions.
- They understand that they are responsible for their transactions.
13.8 External Links: Links to third-party websites are provided for convenience. Like New Only is not responsible for third-party content and users access these sites at their own risk.
13.9 Users agree to indemnify Like New Only from any claims arising from misuse of the Site or violation of laws or third-party rights.
14. RIGHTS AND OBLIGATIONS OF Like New Only
14.1 Like New Only may limit or suspend a User’s access to the Site, or terminate their account, if they:
- Violate these Terms, the Privacy Policy, or other rules of the Site.
- Provide false or incomplete information.
- Act inappropriately, misrepresent themselves, or misuse the Site.
- Sell prohibited items or engage in illegal activities.
14.2 Like New Only can immediately suspend a User’s account without prior notice if:
- The User commits a serious breach of these Terms.
- Engages in fraud, abuse, or misuse of services.
- Sells items for commercial purposes or creates multiple accounts.
- The User violates laws or jeopardizes the safety of others.
- Like New Only faces a legal obligation to act immediately
- There’s a risk to the security or technical operation of the Site.
14.3 Like New Only may partially or fully block a User’s account after sending prior notice. This may limit the User from listing items, communicating with others, or accessing the Site. Full blocking prevents re-registration. Account deactivation doesn’t remove personal data but is retained for legal or operational purposes.
14.4 Like New Only may remove listed items or content if they:
- Violate laws, these Terms, or the Privacy Policy.
- Contradict public order or good morals.
- Are sold by professional sellers or businesses.
14.5 Users can challenge Like New Only’s decisions under sections 14.1 and 14.4 by submitting an email to [email protected]
14.6 Like New Only may reorganize the Site, change the Catalogue, or modify information to improve user experience. Any such changes will not affect User-provided Content.
14.7 Like New Only may announce offers, promotions, or competitions on the Site. In case of conflicting Terms, special conditions will take precedence.
14.8 Like New Only may suspend or transfer the Site’s operations to third parties, with 30 days’ notice (60 days for Quebec users).
14.9 Users can set their account to “Close Listing” mode, which hides their items from the Catalogue. Like New Only may remove unsold items after a long period.
15. PERSONAL DATA Refer to our Privacy Policy for information on how we collect and use your personal data.
16. GOVERNANCE, DISPUTE RESOLUTION, TERMINATION, AND IP RIGHTS
16.1 These Terms are governed by the laws of the User’s province and applicable federal laws in Canada.
16.2 For disputes, Users should first contact Like New Only to resolve the issue. Complaints can be addressed to Customer Service via email at [email protected].
16.3 Users can end their relationship with Like New Only by canceling their account. Like New Only may end the relationship with 30 days’ notice (60 days for Quebec residents), or immediately for serious violations of laws or these Terms.
16.4 Like New Only retains all intellectual property rights to the Site, including its design, software, trademarks, and domain names. No rights are transferred to Users.
16.5 By submitting Content to the Site, Users grant Like New Only a worldwide, non-exclusive license to use, copy, reproduce, and adapt the Content for commercial and operational purposes
16.6 Notifications and communications will be sent via the contact form or email provided by the User.
16.7 These Terms do not create any partnership, labor, or franchise relationships between Like New Only and Users.
16.8 Like New Only may transfer its rights and obligations under these Terms to third parties in certain cases, subject to consumer protection laws. Users may close their accounts if they disagree with the transfer.
16.9 Users can send objections regarding Site access or use via email: [email protected].
17. LIABILITY
17.1 Limitation of Liability
Nothing in these Terms limits or excludes Like New Only’s liability for death, personal injury, fraud, or any liability that cannot be legally excluded or limited.
17.2 No Warranties
Like New Only makes no warranties regarding the Site, its content, or Services, including their accuracy, completeness, suitability, or freedom from errors. Your use of the Site is at your own risk.
17.3 Exclusion of Implied Terms
To the extent permitted by law, Like New Only excludes all implied terms and conditions related to the Site, content, and Services.
17.4 User-Generated Content
Like New Only is not responsible for any content or actions of Site users, including but not limited to:
- Accuracy and completeness of item descriptions/photos
- Quality, legality, or safety of items.
- Seller's ownership or rights related to items or transactions.
17.5 Technical Issues
Subject to Section 17.1, Like New Only is not liable for any loss or damage caused by viruses, denial-of-service attacks, or other harmful materials from using the Site or Services.
17.6 Third-Party Services
Like New Only is not responsible for any third-party services integrated into your account or any resulting losses.
17.7 Exclusion of Liability (Quebec Exception)
If you reside outside of Quebec, Like New Only is not liable for:
- Loss of profits, business, or sales.
- Business interruption or loss of savings, opportunity, goodwill, or reputation.
- Direct, special, indirect, or consequential damages arising from using the Site and Services
18. NO WAIVER
Like New Only will not be liable for any delays or failures to perform obligations caused by circumstances beyond its reasonable control. In such cases, Like New Only is entitled to an extension of time for fulfilling its obligations.
19. SEVERABILITY
If any part of these Terms is found to be invalid or unenforceable by a competent authority, the rest of the Terms will remain valid and enforceable.
20. ENTIRE AGREEMENT
These Terms, along with all referenced documents, constitute the entire agreement between Like New Only and you, replacing any prior agreements. Neither party shall have any claim for misrepresentation not set out in these Terms.
